Developer/Osun state government ignores court order commences erection of buildings on the disputed land
The Prince Ajibola Babarinde lineage of Gbaemu Compound, Osogbo have expressed worry over the alleged invasion of their landed property by a developer believing to be working for Osun state government despite court competent jurisdiction Restraining Order made against the parties from going on the land, subject-matter of this case pending the hearing and determination of the Motions/Applications now pending before this court.
Condemning the disobedient to the court order the Osun Progressive Liberation Minders (OPLM) convener Comrade Adewumi Philip Obenbe said this was happening despite various orders of the court stopping parties from encroaching into the land depending the determination of the court.
"Bricklayers and other workers were sighted on the land on Thursday 26th December, 2024, tippers were equally seen Offloading different kinds of sand and blocks were supplied by block sellers to the site, we have informed the police and we are expecting them to take action.
As a law abiding citizens we are going to follow the path of law to address every illegalities perpetrated by the land grabbers who are using government as a cover up. Obenbe stated"
The family represented by Prince Olalekan Salami, had instituted a matter against the Osun state Governor, Osun state Attorney General and Commissioner for Justice and Honourable Commissioner for Land and physical development in suit number HOS/92/2021 at a Osun State High Court Holden in Osogbo.

A.O Oyebiyi said "In the interest of justice and particularly, Mr J.A Ayanyemi for the Respondents not opposing, a restraining Order is hereby made against the parties from going on the land, subject-matter of this case pending the hearing and determination of the Motions/Applications now pending before this court." The court then fixed 28th January, 2025 for the hearing of pending application.
But, speaking to newsmen on the development, Bashorun Adekanola Desmond Abiodun, the Convener of Osun Must Grow Assembly (OMGA) expressed disappointment in those that are expected to be making and implementing laws fast turning to law brokers by disobeying court orders.
He wondered why the developer and his handlers would jump technical college fence to sell of the family land, when they did not acquire or paid compensation to the family for any property.
On 2nd of June, 2022 an order of interlocutory injunction was granted by His Lordship, Hon. Justice A.O Oyebiyi of Osun state High Court in a case with suit number HOS/92/2021. The court "restraining the Defendants/Respondents i.e (The Executive Governor, Osun state, Attorney General of Osun state and Commissioner for Land and physical planning) their servants, agents, privies and anybody claiming through them from Building, Constructing or Erecting any structure or foundation on or any part of the land in dispute being at Gbaemu family land along Oke -Arungbo, Awosuru Area, Osogbo, Osun state measuring approximately 23.823 hectares."
On 27th November, 2024 “We got a court order, originally Ex perte. We met in court and we argued it and the court made a Consequent Order, directing parties to stay clear of the place pending the hearing, determination of the case.
“We were still on this, they invaded the land with a swamp buggy, despite the court order and started bulldozing and construction.”
“He should know that we are fully prepared. We will not fight them because they are in government, but we are coming with law.”
